We will need a copy of your study permit from the Canadian or Québécois Government, and a letter of acceptance from your school, saying that you will be studying in Montreal for 2 semesters at least.

3. Accept the Rental contract

To book the room, you must accept this rental contract

Rent

1. Rent includes lease rental fees and charges for electricity, heating, hot water, and Internet access.

Charges not included in the rent

2. Rent does not include the following fees:
a) Fees for excessive heating: if the tenant uses the heating excessively, including by setting the thermostat to above 21° C when the heater is on, or by keeping the windows open in winter.
b) In some apartments, the washer and the dryer are in the building (not in the apartment). In these cases, it will cost 2-2.5$ per load per machine.
3. Rent does not include parking space.

Unauthorized expenses

4. Except for emergencies, all expenses related to the apartment and made by the tenant without written authorization (email) from GetYourPlace will be the responsibility of the tenant.

Restrictions

5. It is strictly prohibited to change the apartment’s locks.
6. The tenant can't share his/her code with anyone.
7. No garden/backyard is included in the contract.
8. The tenant is responsible for his/her use of internet.
9. It is strictly prohibited to use a BBQ in the outdoor spaces of the apartment (balcony, terrace...).
10. If the tenant wishes to host someone in the apartment for a few days, he/she will have to write an email to contact@getyourplace.com with his/her roommates in CC, to let GetYourPlace know and to obtain thereby the agreement of his/her roommates. If one of the roommates doesn’t agree, or if GetYourPlace is not aware of the situation, the guest won’t be able to stay in the apartment. If the guest causes any problem in the apartment, he/she will be evicted immediately and the tenant who invited the guest will pay for any damages the guest may have caused.
11. It is strictly prohibited to lock up a bicycle on the balcony or in the stairwell.
12. It is strictly prohibited to attach posters or pictures on the walls in the rooms and common areas, or to paint the walls. In case of non-compliance with this clause, the cost of repairs will be billed to the tenant.
13. Smoking or lighting candles is prohibited inside buildings and apartments. In case of violation of this clause, the tenant will be billed a penalty of $100 plus related costs (including cleaning fees) for each violation. This clause is applicable even if the person who smokes in the building or apartment is a guest of the tenant.
14. Pets are not allowed in the apartments. If a pet is present, the tenant will be billed a penalty of $100 plus related costs, and the pet will be immediately removed from the apartment.

Apartment maintenance

15. The tenant is responsible for keeping the apartment in clean and usable condition for the duration of the contract, all year round.
16. In winter, it is the responsibility of the tenant to shovel the snow from the walkway and driveway, if applicable.
17. For reasons of aesthetics and safety, nothing may be deposited or stored on the balconies, including trashcans, garbage, or other objects that negatively affect the appearance of the apartment or that hinder ease of evacuation through the balconies.
18. The tenant must replace all light bulbs when they burn out.
19. All plumbing costs, such as unclogging the shower, toilet, or sinks, will be billed to the tenant if s/he was the cause.
20. The tenant is responsible for ensuring that the smoke alarms are present in the apartment and work at all times.
21. The tenant is responsible to let GetYourPlace know when the electronic lock battery is low (the electronic lock will become slow to operate).
22. The tenant is responsible for ensuring that all interior doors (bedrooms, bathrooms, etc.) and exterior doors (entrance door and emergency exit) of the apartment are clear at all times.

Cleaning service

23. A cleaning service will handle the common areas (kitchen, bathroom, dining room, living room) every two weeks depending on the apartment, if this option is stated in the clauses of the contract.
24. For apartments featuring the cleaning service, the following steps must be taken before the staff's arrival:
a) All dishes must be washed, dried, and put away in the storage space provided for this purpose.
b) Nothing should be placed on tables and countertops.
c) The trash bins must be emptied, and returnable bottles must be returned.
d) Only one pair of shoes per roommate must remain in the apartment entrance.
e) All common areas must be arranged in order to facilitate the cleaning staff's work (we suggest, for example, that you leave the living room empty of any personal belongings).
If these steps are not done, the cleaning team will charge 10$ per tenant for the extra work necessary.
25. If the contract does not include the cleaning service and if the apartment is not maintained in a clean condition allowing its full use, GetYourPlace will have the right to hire a cleaning service at a rate of up to $30 per hour, and for six hours per month. These charges will be billed to the tenant.

Respect for the roommates and the neighbourhood

26. Since the apartments cannot ensure complete soundproofing, the tenant must have respect for his/her roommates and his/her neighbours.
27. Parties or other large gatherings are strictly prohibited in the apartment and around the building where the tenant is staying.

Payments

28. The monthly rent must be paid online via Canadian bank payment (free), PayPal (4% fees), international bank transfer (15$ fees), or Wise (about 1% fee), no later than the 24th of the previous month. For example, March must be paid no later than February 24th.

Late fees

29. If rent is paid late, the following fees are applicable:
a) 2% of the total if the payment is one day late;
b) 4% of the total if the payment is two days late;
c) 6% of the total if the payment is three days late;
d) 8% of the total if the payment is four days late;
e) 10% of the total if the payment is five days late; or
f) A penalty of 20% will be applied (rent of $500 per month is increased to $600) if the rent is paid more than five days late.
30. The late fee must be paid to GetYourPlace no later than the end of the month when the payment is due. For example, payment for the month of February plus late fees must be paid no later than January 31. If the rent and late fees are not paid by the 31st of the previous month, GetYourPlace has the right to evict the tenant and legal proceedings will be started.

Home insurance

31. Home insurance is provided by GetYourPlace and it is mandatory. The contract details are available on the tenant online account or by clicking on the following link : http://bit.ly/gypinsur . The insurance fee is 25$ per month tax included, and must be paid every 5 months, starting with the 1st rent payment.

Additional fees

32. Additional fees may be charged to the tenant at the end of the contract if one of the following situations occurs:
a) In cases where a part of the apartment is damaged, GetYourPlace will ask the tenant to cover the repair costs.
b) If the tenant fails to return the apartment to the same condition it was in upon the date of move-in, a cleaning fee of $30 per hour will be billed to the tenant.
c) In case of excessive heating, additional heating costs will be charged to the tenant.
33. Additional fees must be paid within 30 days following GetYourPlace's request for payment from the tenant.

Common lease agreement

34. If required by an institution, GetYourPlace may ask the -tenants of the same apartment to sign a common contract with the same conditions as this contract. All -tenants will have to sign this contract. Each -tenant will remain responsible for the rent of his/her room only.

Extension of the contract / Continuation at the premises

35. If the tenant wants to extend his/her or her stay, they must inform GetYourPlace at least three months prior to the end of the contract. GetYourPlace has the right to refuse the tenant's request to continue the contract. In this case, the tenant must vacate the apartment at the end of the contract.
36.⁠ ⁠If the tenant lives in an apartment built less than 5 years ago and wishes to extend his or her stay, the rent increase may reach 15%, in accordance with Article 1955 of the Civil Code of Québec. This clause applies to the following buildings: Sultana (ready to occupy on January 1, 2022), Marcus (ready to occupy on April 1, 2021), Résilience (ready to occupy on November 15, 2024).

Contract termination

37. By signing this contract, the tenant agrees to be responsible for rent payments for the entire duration of the contract. However, the tenant may, with the consent of GetYourPlace, transfer the contract to another person with the same financial capacity as himself or herself, no later than one month before the end of the initial contract.
38. GetYourPlace reserves the right to refuse transfer of the contract that increases financial risk, or if the replacement does not match the socio-demographic profile of our tenants (student or young pro, between 18 to 27 years old).
39. Regardless of transfer, the contract will remain in effect under the same condition to the end of the contract, and the new tenant must agree to comply with the same conditions as the original tenant.
40. Every contract transfer will result in an administrative fee of $95, payable by the original tenant.
41. GetYourPlace may unilaterally terminate the contract if one or more of the following situations occurs:
a) In case of termination of the contract between the owner of the apartment and GetYourPlace;
b) In case the tenant does not respect their roommates and/or neighbors;
c) In case the tenant lets their apartment or shares it with a third party not mentioned in the lease rental agreement;
d) In case the apartment is damaged or not kept in a sanitary and usable condition.
e) In case the contract is for 6 months or more and the tenant can't provide us a proof (study permit, acceptance letter of the university, working permit...) that he/she has the right to stay in the country for the duration of the contract.
42. If any of the situations described in paragraphs b, c, or d occurs, the tenant agrees to a penalty equivalent to a month's rent to be billed by GetYourPlace, to offset damages s/he has caused.

Inventory

GetYourPlace provides free furniture, listed in an inventory sent by email to the client before his or her arrival. The client has three days from the moment s/he takes possession of the furniture to inform GetYourPlace if any furniture is not consistent with the inventory.

Deposit

If any of the furniture has been damaged by the client, GetYourPlace has the right to reimburse these damages with the deposit made by the client, in accordance with the inventory recognized by both parties, GetYourPlace and the client.
If any furniture is broken, and this was hidden from GetYourPlace, the client will be billed a fee of $10, plus any costs involved in replacing the broken furniture.
The deposit will be returned to the client 3 weeks after the end of their contract, via Wise. It may take a little longer if there is a lot of damage.
