3. Accept the Rental contract

To book the room, you must accept the rental contract and the building rules.

Lease Agreement Clauses


A) Rent

The Rent includes the rental fees as well as electricity, heating, hot water, cleaning (when included), and internet access costs.
The tenant insurance provided by GetYourPlace is included in the total Rent amount.

B) Rent Payment

The monthly rent can be paid online:
- by a Canadian bank (free of charge),
- by PayPal (4.11% fee)
- by Wise (approximately 1% fee)
no later than the 24th day of the preceding month. For example, March's rent must be paid no later than February 24th.

C) Late Fees

If the rent is paid late, the legal penalties will apply.
If the tenant is more than three (3) weeks late, GetYourPlace may file a request for lease termination.

D) Charges Not Included in the Rent (Billable to the Tenant)

The rent does not include the following charges:
a) Excessive heating fees: when the tenant uses the heating system excessively, including by setting the thermostat above 21°C while the heating system is running or by keeping windows open during winter.
b) In some apartments, the washer and dryer are located in the building (not in the apartment). In such cases, the cost per load is $2–$2.75 per machine.
c) The rent does not include a parking space.
d) The rent does not include access to a garden or yard. The tenant may not access these areas.

E) Tenant Insurance

Home insurance is mandatory for the tenant. By default, GetYourPlace provides a home insurance for $25/month, subject to adjustment, which is included in the total rent.
The tenant must pay for the GetYourPlace (Lloyd's) home insurance throughout the lease and its renewals.
The tenant must not engage in any activity that increases risk or jeopardizes the insurance coverage.
However, if the tenant prefers to have their own home insurance, they must provide GetYourPlace with proof of home insurance (for the rented unit) from a Quebec insurer with $2 million in coverage, and GetYourPlace will deduct its $25/month fee from the tenant's bills.

F) Keys, Locks and Access

1. The tenant may not share their access code with any third party.
2. A lock or mechanism that restricts access to the unit may not be installed or changed without the consent of GetYourPlace.
3. In the event of a lost key, lockout, or uncharged lock, a travel fee may be charged by GetYourPlace.
4. The tenant will be responsible for all costs incurred for a locksmith's services, unless the locksmith was mandated by GetYourPlace to carry out a major repair for a defect not caused by the tenant.
5. The tenant is required to change the lock battery at least every six (6) months and to confirm the change to GetYourPlace.

G) Furnishings

The apartment is rented furnished. The furniture is listed in an inventory sent by email to the tenant before their arrival. The tenant has 3 days from the moment they take possession of the furniture to notify GetYourPlace if any items do not match the inventory.

H) Cleaning Service (when included)

A cleaning service will take care of the common areas (kitchen, bathroom, dining room, living room...) every two weeks.
The following steps must at minimum be completed before the arrival of GetYourPlace's cleaning team:
a) All dishes must be washed, dried, and stored in the appropriate storage spaces.
b) Nothing should be left on tables or countertops.
c) Garbage bins must be emptied and deposit bottles must be returned.
d) There may be no more than one pair of shoes per roommate in the apartment entryway.
e) All common areas must be tidied to facilitate the cleaning staff's work (it is recommended, for example, to leave the living room free of all personal belongings).
If these steps are not followed, GetYourPlace may charge additional fees incurred by the cleaning team, i.e., $10 per tenant for extra tidying and/or cleaning work.

I) Lease Extension

If the tenant does not wish to extend their stay, they must notify GetYourPlace at least three months before the end of their lease.
If the tenant lives in an apartment built less than 5 years ago and does not wish to extend their stay, the rent increase could reach 15% without intervention from the Tribunal, in accordance with Article 1955 of the Civil Code of Quebec. This clause applies to the following buildings: Sultana (ready to occupy January 1, 2022), Résilience (ready to occupy January 1, 2025).

J) Unauthorized Expenses

The tenant may, after having attempted to inform the lessor, undertake an urgent and necessary repair or expense to ensure the preservation or enjoyment of the apartment.
All expenses related to the apartment made by the tenant without written authorization (email) from GetYourPlace are the tenant's responsibility, except for cases notably provided under the clause "Damage, Defects and Water Damage".

K) Lease Termination

By signing this contract, the tenant agrees to be responsible for rent payments for the entire duration of the lease. However, with GetYourPlace's agreement, the tenant may assign their lease to another person meeting GetYourPlace's requirements, in the same age bracket (18–27 years old) and with similar financial capacity, no later than one month before the end of the initial lease.
Each authorized lease assignment will incur an administrative fee of $95 payable by the assigning tenant.
GetYourPlace may request lease termination if one or more of the following situations occur:
a) In the event that the tenant does not respect the other tenants, building occupants, and/or their neighbours.
b) In the event that the apartment is damaged or not maintained in a sanitary and usable condition.

L) Appendix

An appendix exists that forms an integral part of this lease and is indivisible from it.


Building Rules


Daily Life and Conduct


1) Purpose of the Building

The apartment is intended exclusively for residential use, predominantly occupied by students or young professionals, in accordance with the nature and location of the building. The tenant may not receive client visits, and their occupation of the apartment must not cause any client traffic, delivery of goods or merchandise, or noise that may disturb other occupants of the building.

2) Conduct and Respect for Roommates and Neighbours

The tenant is required to conduct themselves in a manner that does not disturb the normal enjoyment of other tenants. The tenant is held responsible, towards GetYourPlace and other tenants in the building, for damages resulting from a breach of this obligation, even if such breach is caused by persons the tenant grants access to the apartment or building.
The tenant is jointly liable for the actions or faults of occupants, visitors, or agents they grant access to the apartment, as well as goods in their care. The lessor may, in the event of serious harm resulting from such a breach, request lease termination and eviction of the tenant and all occupants of the apartment.
Parties or any other major gatherings are strictly prohibited in the apartment and in the vicinity of the building where the tenant resides.
As apartments cannot guarantee complete soundproofing, the tenant must ensure they respect their roommates and neighbours.

3) Visitors and Guests

If the tenant wishes to have a person from outside the shared housing stay overnight in the apartment, they must, in order to ensure harmony in the shared living arrangement, send an email to contact@getyourplace.com with their roommates in copy, to notify GetYourPlace and thereby obtain the agreement of their roommates.
If the guest causes a problem in the apartment, the guest will be required to leave immediately and the tenant who invited the person will be responsible for any damages caused.

4) Use of Internet Services

The tenant is solely responsible for their use of the internet service and cannot hold GetYourPlace liable in any way.

Use and Maintenance of the Premises


5) Proper Use of the Premises

a) During the lease term, the tenant is required to use the premises in a careful and diligent manner. They must keep the unit and common areas in a good state of cleanliness and perform minor maintenance repairs, with the exception of those resulting from obsolescence or force majeure. The tenant is required to compensate GetYourPlace for losses sustained to the leased property, unless the loss is not attributable to their fault.
b) The tenant will be responsible for costs incurred if the damage is due to their fault or negligence, that of persons occupying the leased premises, or persons they allow access, as well as goods in their care (e.g., toilet clogged by a toy, a pin, unauthorized plumbing modifications, etc.). The costs incurred will be charged to the tenant.
c) The tenant is responsible for snow removal of the common areas of the building, including but not limited to the entrance, driveway, and balconies.
d) The tenant is required to check and ensure that all smoke detectors are present in the apartment and functional. If not, the tenant must replace the batteries or notify GetYourPlace without delay.

6) Housekeeping

If the lease does not include a cleaning service and the apartment is not maintained in a state of cleanliness that allows for its full use, GetYourPlace may then engage a cleaning service at a rate of $45 per hour, for up to 6 hours per month. These fees will be charged to the tenant.

7) Storage

The tenant may only store their belongings or allow goods to be stored in designated and identified areas. The tenant may not store objects in common areas, including access routes, in front of any door, or on the grounds. It is strictly forbidden to store combustibles or flammable products inside the building.

8) Common Areas

The tenant and all persons living in the unit agree not to use the common areas of the building — such as stairwells, hallways, or entrance halls — to play, loiter, or store personal belongings. This includes bicycles, shoes, garbage or recycling bins, and any other objects. They will also ensure that emergency exits (in the apartment and building) are not obstructed with their personal belongings.
Smoking is also prohibited in all common areas.

Decoration and Modifications


9) Interior Appearance of the Apartment

The tenant agrees not to install in the apartment, whether in the bedrooms or common areas, any posters, signs, framed pictures on the walls, wallpaper, wall coverings, string lights, or use any paint. Costs for restoration will be charged to the tenant who violates this article.

10) Telephone or Other Cabling

It is strictly forbidden for the tenant to install or allow the installation of telephone cabling, a cable distribution system, or any other system requiring drilling through the walls of the building without written authorization from GetYourPlace.
In the event of a defect in any of the above, the tenant may not carry out or have carried out any repair without having received approval from GetYourPlace. If the tenant fails to request this approval, they agree to bear all costs of work for damages caused.

11) Exterior Appearance and Balcony

It is strictly forbidden to hang from windows, railings, stairwells, doors, or balconies of the unit, and generally any modification that could affect the visual or architectural harmony of the building, including rugs, doormats, clothing, sheets, duvets, mops, dish towels, canoes, flags, bicycles, tires, etc.
However, clothing and rugs may be hung in the designated area, i.e., on the clothesline, where applicable.

Noise and Sound Equipment


12) Home Theatre, Sound Equipment

It is strictly forbidden to use a subwoofer for home theatre, computer, any electronic device, or any other device that can produce a similar sound.

Tobacco, Drugs and Substances


13) Cigarettes, Cannabis, Smoke and Other Substances

a) It is strictly forbidden to possess or smoke in any form cigarettes, vaporizers, cigars, pipes, or any drug inside the apartment, on balconies, and within the limits of the property.
b) The tenant may not light candles or incense in the apartment or any part of the building.
c) If there is a complaint from other tenants due to a violation of this regulation, particularly due to cigarette or drug smoke nuisance, GetYourPlace will issue a written warning to the tenant. If the tenant continues to violate the regulation, GetYourPlace may immediately file a request for lease termination and obtain the tenant's eviction.
d) The tenant who violates this article will be charged a penalty of $100 per occurrence of the infraction, plus related costs such as cleaning fees. The penalty will be charged even if it is the tenant's guest who violates this article.
e) In such a case, GetYourPlace reserves the right to claim damages from the defaulting tenant, including for lost revenue and disturbances caused.

Animals


13) Animals

1. No animal may be kept inside the unit or on the grounds, including but not limited to dogs, cats, birds, reptiles, rodents, etc. Any tenant or occupant who keeps such an animal inside the unit must, within two weeks of receiving written notice, permanently remove the animal. GetYourPlace reserves the right to request lease termination or claim damages for the presence of the animal and any damage it may have caused.
2. The tenant agrees not to feed pigeons, seagulls, squirrels, or other wild animals that could constitute a nuisance on properties managed by GetYourPlace.

Safety and Prevention


14) Damage, Defects and Water Damage

Tenants are required to notify GetYourPlace as soon as possible of any damage, defect, or incident (e.g., water damage). Should the tenant fail or neglect to notify GetYourPlace, repairs will be carried out at the tenant's expense without GetYourPlace having to quantify the damages caused by the aggravation.

15) Waterbeds and Aquariums

It is strictly forbidden to install a waterbed in the unit or to own an aquarium of any type.

16) Barbecue

The tenant may not use a barbecue either inside the apartment or building, or outside, including on terraces, balconies, and the grounds. Under no circumstances is it permitted to keep or store a propane gas cylinder inside.

Administrative and Financial Matters


17) Joint Lease

If required by an institution, GetYourPlace may ask tenants in the same apartment to sign a joint lease under the same conditions as the present contract. All tenants must sign this contract. However, each tenant will remain responsible only for the rent of their own room.

18) Additional Fees

Additional fees may be charged to the tenant at the end of the lease if the following situations occur:
a) If part of the apartment is damaged, GetYourPlace will ask the tenant to pay the repair costs.
b) If the tenant fails to return the apartment in the same condition it was in at the move-in date, cleaning fees of $45 per hour will be charged to the tenant.
c) In the event of excessive heating, the additional heating costs will be charged to the tenant.
Additional fees must be paid within 30 days following the payment request made to the tenant by GetYourPlace.

19) Compliance with Laws and Regulations

The tenant is required to comply with all applicable municipal and provincial laws and regulations, as well as building or co-ownership regulations, as applicable. In the event of a violation of these laws and/or regulations, the tenant agrees to reimburse any fines received and to repair any damages suffered by the lessor.

20) Rents for Similar Rooms and Apartments

The Lessor agrees to make reasonable efforts to ensure pricing consistency between similar rooms and units within the building.
Under no circumstances may a price discrepancy between two leases be invoked by the Tenant to contest the agreed rent, request a rent reduction, or hold the Lessor contractually liable.

21) Condition of the Premises

Upon moving in, the tenant must complete a condition report via an online form. In the absence of a move-in condition report, the tenant is presumed to have received the unit in good condition at the start of the lease. A condition report may also be completed at the end of the lease.


By their signature, the tenant confirms having read the Building Rules and irrevocably agrees to comply with them as well as the Lease Agreement.
